About these terms
In these terms, PETAA means the Primary English Teaching Association trading as Primary English Teaching Association Australia (PETAA) ABN 36 002 557 075, and you means the person whose details are entered during the online purchase process.
These terms apply to purchases of physical products and digital publications (including eBooks) made through the PETAA Online Store.
Online courses are governed by separate course-specific terms, which are provided at the point of enrolment and apply in addition to PETAA’s Website Terms of Use and Privacy Policy. These Online Store Terms do not apply to online course access, progress, completion, certificates or expiry.
Capitalised terms have the meanings given in the Definitions section or elsewhere in these terms.
When PETAA accepts an Order placed by you in accordance with these terms, a binding contract is formed between you and PETAA (Contract). The Contract may only be varied by PETAA in writing or by email.
PETAA may update these terms from time to time. Updated terms apply to Orders placed after the date they are published on the Website.
Orders, prices and payment
Product listings on the PETAA Online Store constitute an invitation to treat only and do not constitute an offer to supply.
Orders must be placed through the PETAA Online Store checkout process. Orders submitted in any other form will not be accepted.
All prices are in Australian dollars and include GST. Postage, freight and handling charges (if applicable) will be disclosed at checkout and are payable in addition to the listed price.
Available payment methods will be displayed at checkout. Where payment is made by credit or debit card, PETAA may obtain pre-authorisation prior to processing the Order. Payment is processed when Products are supplied or dispatched.
Digital products (including eBooks)
Some Products are supplied in digital format, including downloadable publications and eBooks (for example, EPUB or PDF files).
Digital Products are supplied by electronic delivery and are deemed delivered when access is provided or a download link is made available.
Digital Products are licensed for personal use or internal school use only, in accordance with the applicable membership or purchase conditions. Digital Products must not be shared, redistributed, resold or made publicly available except as permitted by law or expressly authorised by PETAA.
Unless required by law, Digital Products are non-refundable once supplied.
Online courses
Purchases or enrolments in PETAA online courses are governed by separate course terms and conditions. These Online Store Terms do not apply to online course access, learning platforms, progress, completion, certificates or expiry.
Cancellation
Orders cannot be cancelled once submitted.
PETAA reserves the right to refuse or cancel an Order at its discretion. If an Order is cancelled after payment has been made, PETAA will refund the amount paid as soon as reasonably practicable.
Shipping (physical products only)
Physical Products will be shipped to the delivery address specified in your Order.
PETAA will use reasonable efforts to meet any stated delivery estimates; however, delivery times are indicative only. Subject to applicable Consumer Guarantees, PETAA is not liable for delays or failure to deliver.
Title to physical Products passes to you once payment is received in full. Risk passes on delivery.
Returns and refunds
Nothing in these terms limits your rights under the Australian Consumer Law.
- PETAA does not offer refunds or exchanges for change-of-mind purchases.
- Physical Products supplied correctly in accordance with an Order are supplied on a firm sale basis.
- Returns require prior authorisation from PETAA.
- Where a return is approved, PETAA may replace the Product, issue a refund, or provide a credit at its discretion.
- Digital Products are not refundable once supplied, unless required under an applicable Consumer Guarantee.
Our liability to you
To the extent permitted by law, all warranties, conditions or other terms not expressly stated in these terms are excluded. If a Product fails to comply with a Consumer Guarantee, you are entitled to remedies under the Australian Consumer Law.
Subject to that:
- PETAA is not liable for indirect or consequential loss, including loss of profits, data or business opportunity; and
- PETAA’s total liability is limited to the amount paid by you for the relevant Product.
Other terms
PETAA is not liable for failure or delay in performance caused by events beyond its reasonable control.
PETAA’s Privacy Policy applies to personal information collected in connection with Orders, payments and customer enquiries.
These terms constitute the entire agreement between you and PETAA in relation to purchases made through the Online Store.
These terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of the courts of New South Wales.
Definitions
Consumer Guarantee means a consumer guarantee under Division 1 of Part 3-2 of the Australian Consumer Law.
Contract means the contract formed when PETAA accepts an Order.
Digital Product means a Product supplied electronically, including eBooks and downloadable publications, but excluding online courses.
eBook means a Product supplied in electronic book format, including EPUB or PDF files.
Order means an order placed through the PETAA Online Store.
Product means a product listed on the PETAA Online Store that PETAA agrees to supply in accordance with these terms.
